Ministry of Justice Reforms are to be implemented on 1st August 2013 which will significantly change the way Employers’ & Public Liability claims, valued under £25,000 are dealt with in England & Wales. The aim is to reduce claim settlement times and solicitors’ costs.

What this means for you

If the new protocol is successful it should reduce the overall cost of insurance claims and ultimately drive down insurance premiums.

How this affects Insurers

The reforms reduce the period of time insurers have to investigate claims, from the 90 days allowed by the existing protocol, to 30 working days for Employers’ Liability claims and 40 working days for Public Liability claims.

In order to ensure that claims remain within the new system it is essential that insurers make the correct decision regarding liability. They must therefore be in receipt of all of the facts before they decide whether to accept or deny liability. Making the wrong decision will drastically increase the cost of the claim.
